Is the seizure of someone’s property in order to obtain payment of money owed. Distraint may be as a result of the exercise of a warrant of execution by a Bailiff on behalf of a creditor, it may be by the statutory right to distrain e.g. HMRC in relation to tax debts, or it may be the common law remedy available to landlords for the non-payment of rent.
